One submission was received and, upon evaluation, did not meet the requirements of the Council.

    Council is advertising for EoI's saying there could be up to 6,500 sq metres of buildings floor space generated. What would that mean in terms of the height of each of the suggested buildings, in metres please? Would that breach the LEP height limits? How can council, which owns the site and sets the LEP rules, lead developers to submit projects which are over the LEP height limit, particularly as the Town Centre Master Plan and the Futureproofing Plan have not been adopted, nor agreed by the community.

    Council is seeking the redevelopment for the former TAFE site as a precinct rather than as individual builds and sites.  This allows for concept plans to be put forward that consider the potential interrelationships between the existing heritage buildings and future buildings, potential laneways, and public spaces.  The process aims to realise the unique opportunities that this site presents. 

    The current Bathurst Regional Local Environmental Plan (LEP) 2014 does not set a height limit for the majority of the precinct.  There is no automatic entitlement to develop the precinct to the full extent potentially permitted by the application of a particular planning control (or lack of a planning control) applicable to a site. 

    In the absence of a height restriction applicable to the majority of the site, form and scale of any new buildings will have to be identified, having regard to all the applicable planning controls as well as site and precinct  considerations including matters arising from, and with respect to, the interaction between the site and neighbouring development; heritage significance; other relevant applicable provisions of the LEP; and relevant applicable provisions of the development control plan.

    All proposals will be required to consider and be complementary to the heritage significance of both the site and the Bathurst Town Square.  This heritage is represented in buildings, but also in the potential future public access lanes and public spaces. The significance of the site and how that should generally be managed is outlined in the  Conservation Management Plan (CMP) prepared for the site. The recommendations of the CMP are not planning standards. A future heritage impact statement will outline how the matters raised in the CMP have been considered and addressed and would inform a future development application.

    Council will not be the consent authority for the proposal, it will be considered either Regional or State Significant development and will therefore be assessed by the NSW State Government.
