Pre-development application meetings for certain developments within the Heritage Conservation Area
Development controls within the Development Control Plan provide for the orderly development of land and establish minimum standards that apply to the land when it is developed. Details of the controls are outlined below.

LED lighting
Amend Section 3.3.1 and Section 11.3.1 in relation to subdivision of land requiring new street lighting to be LED lights.
Amend Section 11.3.1 in relation to new lighting in public areas to be a LED light.
Council has been working with Essential Energy to upgrade the existing street lighting to more efficient LED lights within the Bathurst Region. The upgrade works are likely to commence in April 2019. The effect of the proposed amendment is to require any new residential subdivisions to install LED lighting for street and public areas.

Two storey dwellings
Amend Section 4.4.2 in relation to overshadowing from two-storey dwelling houses not associated with a dual occupancy or multi unit developments.
The effect of the proposed amendment is to provide clarification that new two-storey dwellings or alterations/additions to dwellings containing a two-storey component, are to consider the impacts of overshadowing on adjacent properties. This will be consistent with the requirements for dual occupancy and multi-unit dwelling developments.

Fire system requirements for certain developments
Amend Section 4.10.2 in relation to fire hydrants for developments where there is more than one dwelling on the site.
The NSW Fire Brigade have updated their requirements relating to fire protection for certain developments. The effect of the amendment is to reference the new NSW Fire Brigade guidelines.

Pre-development application meetings for certain developments within the Heritage Conservation Area
Insert a new provision after 10.1 Preliminary, as 10.1A – Pre-development application meetings – Heritage.
Note: The wording of the new section is attached to this explanation document.
The intent of the provision is to provide guidance for the development of properties in a heritage conservation area. The new section will provide the framework for developments that require pre development application meetings in heritage conservation areas and/or Heritage Items. The introduction of the meetings will ensure formal advice is given to the applicant prior to an application being lodged with Council for consideration. This is in addition to any meetings with Council’s heritage advisor.
The draft DCP Amendment is on exhibition for a period of 28 days from 28 July 2018 to 24 August 2018. Submissions must be received before the close of business on 24 August 2018.
