Consultation has concluded

The Department of Planning and Environment (DPE) is currently exhibiting the translation of existing Business and Industrial zones across all local government areas in NSW into the new Employment zones. Business and Industrial zones will be replaced by the new Employment zones under the Standard Instrument (Local Environmental Plans) Order 2006 as part of the NSW Government’s reform package.

The exhibition details how each Local Environmental Plan (LEP) that includes a current Business or Industrial zone will be amended to use the new Employment zones. The exhibition is being held on the Department’s Planning Portal from 31 May 2022 to 12 July 2022.

Under the Bathurst Regional Local Environmental Plan 2014, the zone name changes will be as follows:

The lands to which the current and new zone names apply does not change from the current locations.

The range of permitted uses in the new zones generally remains unchanged except in relation to the new E1 Local Centre zone. As part of the reforms, the DPE will make landscaping material supplies, local distribution premises, rural supplies, specialised retail premises, timber yards and vehicle sales and hire premises permitted with consent in the E1 Local Centre zone. These landuses are currently prohibited development in the B1 Neighbourhood Centre zone. A new special provision will be inserted into the Bathurst Regional Local Environmental Plan 2014 to limit the size of landscaping material supplies, local distribution premises, rural supplies, specialised retail premises, timber yards and vehicle sales and hire premises within the E1 Local Centre zone to a gross floor area of 400sqm to ensure the size of these types of premises are consistent with other speciality stores located within the City’s neighbourhood shopping locations.

Making submissions

Please note that submissions should be made via the search webforms on the planning portal, so that the detail can be linked to a specific site, employment zone or local government area. Submissions made in free format may not be able to be considered in detail. Given this exhibition applies across the state the preferred submission format prepopulates property identifiers to enable an efficient and clear alignment of submission to LEP so that the Department and council can review feedback and finalise amendments by September.
